Bankruptcy Law

Creditors experiencing bankruptcy, insolvency, and other creditor/debtor situations face a unique set of issues and problems, as bankruptcy allows debtors to obtain relief from some debts. Many creditors wonder how they will recover what they are owed, and the journey to financial recovery can be challenging to navigate independently. The attorneys at Sessions, Fishman, & Nathan, L.L.C. have the legal knowledge and experience needed to support its clients in this technical and complicated practice area.

Decades of Experience

Our commercial bankruptcy and creditor/debtor relations lawyers have been representing primarily lenders, commercial lessors, and other secured, administrative, and unsecured creditors in business reorganization and other bankruptcy, insolvency, and related litigation proceedings for over 45 years—even before the advent of the 1978 Bankruptcy Code.

David Forsyth has consistently been listed as a “best lawyer” in various publications including Chambers USA Best Lawyers for Business, Best Lawyers in America, Louisiana Super Lawyers, and New Orleans Magazine. He has been selected as “Lawyer of the Year” in the practice area of Bankruptcy and Creditor Debtor Rights/Insolvency and Reorganization Law and Litigation – Bankruptcy by Best Lawyers in America, and has regularly spoken and written on various bankruptcy-related topics. Another member of our team is the author of the authoritative Louisiana real estate treatise, whose expertise is invaluable in real estate-driven business reorganization proceedings and litigation.

Local and National Commercial Bankruptcy

Though our firm’s commercial bankruptcy practice includes all aspects of bankruptcy and insolvency and creditor/debtor relations, both transactional and litigation, we also have particular expertise in real estate-related matters. This includes local and national shopping center and other retail reorganization cases, real estate and other asset purchases out of bankruptcy proceedings, and commercial foreclosures and loan work-outs. David Forsyth has served for years on the Bankruptcy Taskforce for the International Council of Shopping Centers and has been involved in lobbying and other efforts with respect to legislation important to the shopping center industry.

We’ve also participated as counsel for major players in asbestos and other mass tort business reorganization proceedings, including acting as counsel for the future asbestos-related claimants under Bankruptcy Code section 524(g) in a large asbestos case in New Orleans. Our firm has advised the Claims Administrator appointed by the United States District Court to oversee and implement the Deepwater Horizon oil spill settlement in bankruptcy-related and other issues.
